Terms of Service

These Terms of Service (“Terms”) govern access to and use of Orcastrator’s websites, product, and related services (the “Service”). By accessing or using the Service, or by clicking to accept these Terms when you create an account, you agree to them on behalf of yourself or the organisation you represent.

If you are accepting for an organisation, you represent that you have authority to bind that organisation. If you do not agree, do not use the Service.

Orcastrator is a quality control plane for software teams. It includes capabilities such as Blueprints, test management, Sonar AI authoring assistance, orchestration, live execution, and Pulse risk insight, as described in our documentation and your plan.

We may modify features, provided we do not materially reduce core paid functionality during a prepaid term without notice or an appropriate remedy as described in your order form or enterprise agreement.

You must provide accurate registration information and keep credentials confidential. You are responsible for activity under your accounts and for users you invite. Organisations may enable Microsoft Entra ID SSO and related provisioning; administrators remain responsible for correct identity configuration and role assignment.

We may suspend access for unpaid invoices (after any payment-grace period described in-product), security risk, or material breach of these Terms.

You retain ownership of content you submit to the Service (“Customer Content”), including blueprints, specs, tests, run evidence, and related project data. You grant Orcastrator a limited licence to host, process, transmit, and display Customer Content solely to provide and secure the Service, and as otherwise directed by you.

You represent that you have the rights needed to submit Customer Content and that it does not violate law or third-party rights. Do not upload secrets you are not authorised to share, or content that is unlawful or abusive.

Sonar AI may suggest outlines, steps, or other assistance grounded in your project context. Suggestions are drafts for human review. You are responsible for reviewing and approving published test assets. We do not guarantee that AI output is complete, correct, or fit for a particular purpose.

Paid plans, free Hobby limits, trials, and retention windows are described on our pricing page and in-app billing. Fees are billed in advance unless an order form says otherwise. Taxes may apply.

Payment processing is handled by Stripe. Failed payments may result in restricted access after any grace period. Unless required by law, fees are non-refundable once a billing period has started, except where an enterprise agreement provides otherwise.

You must not:

• Probe, scan, or attack the Service except via coordinated disclosure
• Interfere with other customers or reverse engineer the Service except where law permits
• Use the Service to violate law, privacy, or intellectual property rights
• Resell or provide the Service to third parties except as allowed in your agreement
• Circumvent plan limits, access controls, or billing mechanisms

The Service, including software, branding, and documentation, is owned by Orcastrator and its licensors. These Terms do not transfer ownership to you. Feedback you provide may be used to improve the Service without obligation to you.

Our Privacy Policy explains how we handle personal data. Where we process Customer Content that includes personal data as a processor, the DPA applies.

Except as expressly stated in a signed enterprise agreement, the Service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that it will catch every defect in your software.

To the maximum extent permitted by law, Orcastrator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data, even if advised of the possibility.

Our aggregate liability arising out of these Terms or the Service is limited to the amounts you paid to Orcastrator for the Service in the twelve (12) months before the claim. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

These Terms continue while you use the Service. You may stop using the Service and close accounts as provided in-product. We may terminate or suspend for material breach, unlawful use, or extended non-payment. Provisions that by nature should survive (including IP, disclaimers, limitations, and indemnity obligations in an enterprise agreement) will survive termination.

Unless a signed order form or enterprise agreement specifies otherwise, these Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. Courts in England and Wales have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction to protect our IP or the Service.

We may update these Terms by posting a revised version with a new “Last updated” date. Continued use after the effective date constitutes acceptance, except where an enterprise agreement requires a different change process.
